Terms of Service

Draft for legal review. Highlighted items must be confirmed before this page is published.
1. Who we are
Bright Tape (brighttape.app) is run as a sole proprietorship based in Switzerland (“we”, “us”). The owner’s name and postal address are listed in the Imprint. You can reach us at info@brighttape.app.
These terms apply when you create an account or buy a membership. By doing either, you agree to them.
2. What the service is
Bright Tape gives members analysis of Bitcoin price action and model-generated forecasts of where upcoming candles could close across several timeframes, together with a projected price path.
Bright Tape is a research preview. The models are still being developed, their predictive value is not proven, and results may change as we improve them. Continuous model development is part of every membership.
- Forecasts are statistical estimates produced by our models. They can be wrong, and they are the same for every member.
- We do not know your finances, goals or trading activity, and nothing in the service is tailored to you.
- We do not execute trades, connect to your exchange or broker accounts, hold money or crypto-assets, or tell you to buy or sell anything.
- The timeframes, forecast horizons and features we offer may change as our models develop.
3. Not investment advice
We are not a bank, securities firm, asset manager, financial adviser or crypto-asset service provider, and we are not supervised by FINMA or any other financial market authority. The service provides general market information. It is not investment, financial, legal or tax advice, and it is not an offer or recommendation to buy, sell or hold Bitcoin or any other asset.
Every trading decision is yours, and so is the risk. Read the Risk disclosure before you use the service, and consider speaking to an independent adviser.
4. Your account
- You must be at least 18 years old.
- Give accurate information and keep your sign-in details secure. Sign-in is provided by Clerk.
- A membership is for one person. Do not share your account.
- Tell us promptly if you think someone else has used your account.
5. Memberships and prices
- 7-day pass: €12.99, one payment. It gives the same access as Pro, starts when you pay and ends seven days later. It does not renew.
- Base: predictions up to 5 candles ahead, €19.90 per month renewing every month, or €199 per year renewing every year.
- Plus: predictions up to 10 candles ahead, €29.90 per month renewing every month, or €299 per year renewing every year.
- Pro: predictions up to 20 candles ahead, €39.90 per month renewing every month, or €399 per year renewing every year.
The number of candles is a maximum. The model predicts fewer candles on some timeframes (currently 5 on the 1-minute chart and 10 on weekly and longer charts), and every tier is limited by that.
You can change tier or billing period from your account. Moving to a higher price takes effect immediately and you pay the difference for the rest of the current period. Moving to a lower price takes effect at the end of the current period.
Research pricing
These are research prices, available for up to 100 active monthly and annual memberships across all tiers. If you subscribe at a research price, you keep it for as long as your membership renews without interruption. If you cancel and subscribe again later, the price at that time applies. Prices for new members may change after the research period.
Prices are in euros and include VAT where VAT applies. Checkout can show the price in your local currency. In that case Stripe converts it at an exchange rate that includes a conversion fee, which you see before you pay. Your bank may charge its own fees.
Payments are processed by Stripe. We never see or store your full card details.
6. Renewal and cancellation
Monthly and annual memberships renew automatically at the end of each billing period and are charged to your saved payment method until you cancel.
- You can cancel at any time from your account under Manage billing. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Apart from your right of withdrawal in section 7, or where the law requires otherwise, we do not refund the unused part of a billing period.
- Research prices stay fixed while your membership continues. For any other price change, we will tell you at least 30 days before the new price applies to a renewal, and you can cancel before then.
- If a renewal payment fails, Stripe may retry it. If it keeps failing, your access ends.
7. Right of withdrawal for consumers in the EU and EEA
If you are a consumer living in the European Union or the European Economic Area, you can withdraw from your contract within 14 days without giving a reason. The period starts on the day the contract is concluded, which is the day you complete payment.
Access that starts immediately
At checkout you ask us to start your access straight away, before the withdrawal period ends. As a result:
- If you withdraw from a monthly or annual membership within 14 days, we refund what you paid minus an amount proportionate to the days of access you used before telling us.
- A 7-day pass is fully performed once its seven days have run, and your right of withdrawal ends at that point. If you withdraw earlier, we refund the unused days proportionately.
How to withdraw
Send us a clear statement that you are withdrawing, for example by email to info@brighttape.app. You can use the model form below, but you do not have to. Your statement only needs to reach us before the 14 days have passed.
Refunds
We refund you within 14 days of receiving your withdrawal, using the payment method you used, unless you expressly agree otherwise. You will not pay any fees for the refund.
Model withdrawal form
To Bright Tape, at the postal address in the Imprint or by email to info@brighttape.app:
I hereby give notice that I withdraw from my contract for the following service: Bright Tape membership.
Plan and date of purchase: ___ · Name: ___ · Email address of the account: ___ · Date: ___
Consumers outside the EU and EEA
The right of withdrawal in this section applies only to consumers living in the EU or EEA. Swiss law and many other legal systems do not give a statutory right of withdrawal for online contracts, and we do not offer one outside the EU and EEA.
8. Using the service fairly
Your membership is for your own use, which includes making your own trading decisions. You may not:
- share, resell, publish or redistribute forecasts, projected paths or analysis, in full or in part, including in groups, channels or other products;
- use bots, scrapers or other automated means to access or copy the service;
- use the service or its outputs to build, train or test models or competing products;
- share your account, get around access controls or interfere with the security of the service.
We may suspend or close accounts that break these rules.
9. Intellectual property and market data
The service, including its software, models, forecasts, charts and text, belongs to us or our licensors. While your membership is active, you have a personal, non-transferable right to use it under these terms.
Prices in the service come from third-party market data sources. We do not guarantee that this data is complete, accurate or current, and the providers of that data are not responsible for the service.
10. Availability and changes
We aim to keep the service available and its forecasts current, but we cannot promise uninterrupted operation. Maintenance, data source outages or model issues can make forecasts late or unavailable. When a forecast is out of date or unavailable, we aim to show that clearly.
We may change, add or remove features. If a change substantially reduces what you paid for, you can cancel and receive a proportionate refund for the unused part of your current billing period.
11. No warranty
To the extent the law allows, the service is provided as it is and as available. We do not promise that forecasts will be accurate, that the service will meet your expectations or that using it will improve your results.
12. Liability
To the extent the law allows, we are not liable for trading or investment losses, lost profits or other indirect or consequential damage arising from your use of the service or reliance on its content. Our total liability for any other claim is limited to the amount you paid us in the 12 months before the claim arose.
Nothing in these terms limits our liability for intent or gross negligence, for injury to life, body or health, or any liability that cannot be limited under mandatory law, including consumer protection law.
13. Ending the contract
You can cancel your membership at any time as described in section 6, and you can ask us to delete your account by email. We may end or suspend your membership if you seriously or repeatedly break these terms. If we end your membership for any other reason, we refund the unused part of your current billing period.
14. Changes to these terms
We may update these terms, for example when the service or the law changes. We will tell you about material changes by email or in the service at least 30 days before they apply. If you do not agree, you can cancel before the change takes effect. The terms that applied when a billing period started continue to apply to that period.
15. Governing law and disputes
These terms are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. The competent courts at the owner’s place of business in Uitikon, Canton of Zurich, have jurisdiction.
If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you can also bring proceedings in the courts of that country.
